How is a civil case commenced in the state of North Carolina?
Generally, a civil case is commenced in North Carolina by the filing of a Complaint with the Clerk of Superior Court in the county in which the action will be prosecuted. At the time the Complaint is filed, the Clerk of Superior Court will issue a Civil Summons which must be served upon the defendant(s) along with the Complaint.
