How far back can I go to recover fair pay and overtime wages?
The law normally permits an employee to go back two (2) years from the date their complaint is filed in Court. In certain instances, where the Court determines that the employer knew it was violating the law or willfully disregarded its obligations under the law, the Court may extend the period to three (3) years, or even longer. Additionally, in some cases, employers are required to pay double the amount of unpaid wages, and attorneys’ fees.
