How does “unique or peculiar” fit in with rent stabilization?
The landlord has only 60 days from the date you left Mitchell-Lama and entered rent stabilization to try to change the “initial regulated rent” based on supposedly “unique or peculiar circumstances.” DHCR regulations state that just leaving Mitchell-Lama is not by itself a “unique or peculiar circumstance” – but landlords are challenging that regulation in court. You can expect that the owner will file an application for each apartment as long as the court case is pending, which may take years. Legislation – A.9230/S.3326-A would solve this problem if it is passed.
