How does the Statutory Exemption Section apply?
The Top-Screen asks a series of questions related to the statutory exemptions that apply to CFATS. A facility that answers “Yes” to any one of these questions will then exit the Top-Screen without providing any additional data. Facilities may also be partially exempt depending on the type of activity carried out at the facility. In that event, the facility will be directed to complete the Top Screen for the non-exempt portions of the facility. Please note that even though a facility may exit the Top Screen by claiming an exemption, DHS does not necessarily concede the applicability of such an exemption in any given case.
