How does the rule affect R.S. 2477 rights-of-way?
A. Public roads authorized by legally documented rights-of-way are not subject to designation under the final rule. The definitions of National Forest System road and National Forest System trail in the final rule exclude rights-of-way under R.S. 2477 that have been adjudicated or otherwise formally established. The Forest Service does not want to give the appearance of establishing the validity of unresolved R.S. 2477 right-of-way claims through this final rule.
