How does the retailer receive the Administrative Complaint for Civil Money Penalties?
FDA will serve the Complaint together with a cover letter on the retailer by certified or registered mail or personal delivery. The letter explains that the retailer is entitled to a hearing according to the procedures established in FDA’s regulations on civil money penalty proceedings in 21 Code of Federal Regulations (CFR) Part 17. The CFR is available at many libraries, on the Internet at http://www.access.gpo.gov/, or can be obtained by calling 1-888-FDA-4-KIDS for a copy.
