Under the Patent Act, the Board is required to consider changes in the Consumer Price Index (CPI) in determining if the price of an existing patented medicine is excessive. The PMPRB’s Guidelines on Excessive Prices are based on the factors in the Act and, among other things, they provide that increases in the price of an existing patented drug should not be greater than increases in the CPI.
