How does the OFT uncover illegal cartel activity?
In order to investigate and obtain sufficient evidence to prosecute individuals for the criminal cartel offence, the OFT has been given wide-ranging investigative powers. The OFT may require persons to answer questions, provide information or produce documents. They may also conduct an unannounced inspection – entering and searching premises under a warrant (also known as a ‘dawn raid’) and conduct intrusive surveillance operations. Where a case is particularly serious or complex the OFT may ask the Serious Fraud Office to become involved. An investigation usually follows complaints made to the OFT by customers, or ‘inside’ information provided by a whistleblower. Why blow the whistle?
