How does the court divide personal property?
The court hopes that the parties can divide household goods such as furniture, furnishings and fixtures between them in ways that make sense without the assistance of the court. If the parties cant, the court will wade in and consider personal property issues, and make as near an equal distribution as they can. People should be aware that the courts patience and interest in determining the value of small items and making a perfect division of personal property between the parties is limited. Personal property issues usually dont take much time in a divorce action unless there are unusually large assets that are difficult to value, or that require expert testimony as to value. These might include for example the value of business owned, unique properties, antiques, jewels, etc.
