How does publication of an invention or discovery affect patent rights?
Foreign patent rights are lost immediately upon any publication, including an abstract. To protect patent rights in the U.S., a patent application must be filed within one year from the date of publication. The protection of rights occurs upon filing of the application. The actual issuance of a patent may take several years.
