How does Proposition 218 apply to restructuring the Stormwater Fee?
The proceedings which govern the restructuring of the fee is in strict compliance with the 1996 Taxpayers Right to Vote on Taxes Act (Proposition 218), which was authored by the Howard Jarvis Taxpayer’s Association, and its implementing legislation. The basic premise of the law is that only property owners (as opposed to renters or residents outside of the impacted area) should be able to file a protest on new or restructured fees on their property.
