How Does Probate Start?
In New York, the probate process begins when a petition and original last will and testament are submitted to the Surrogate’s Court in the county where the decedent lived. Included in the petition is the decedent’s date of death, the name of the executor, the beneficiaries named in the will, the heirs that would inherit if the will is deemed invalid, and the estimated value of property and assets passing under the will.
