The 501a statute in Massachusetts is one of the most discriminatory and unconstitutional pieces of state legislation that I’ve ever dealt with. The “victim” (yes the actual statute uses words like victim and abuser, not plaintiff and defendant, which further enhances the grossly bias statute) can appear in court at any time during normal hours and vacate it. Of course it is up to the judge, and sometimes they choose to leave it in effect despite of the wishes of either party or against all logic. The “abuser” can motion to have it vacated or have the terms changed but needs to show that the “victim” has done something that demonstrates they are clearly not in fear. Like trying to contact them or showing ulterior motives. Long story short with my personal experience with this, I had a girlfriend who after I dated for almost a year maliciously took one of these out on me to in her words “get rid of and get back at me” for informing her new secret boyfriend that she was still seeing me.
