Unemployment is NOT earned income, so it won’t qualify you for earned income credit. As far as EIC goes, you look up both the earned income and the AGI and use whatever amount is smaller. Since the Earned Income will be $20K and the AGI will be $39,200, you will not qualify for EIC since your AGI is too high.
