How Does a Court Reach a Decision in a Divorce Case?
In the event that the attorneys are able to negotiate a settlement, it will be reduced to a written Separation Agreement. Tis agreement will be submitted to the court for review and approval. In deciding whether to approve the agreement, the Court will review the Financial Statements to determine whether the agreement is fair and reasonable. If the Court determines that the agreement is fair and reasonable, it will incorporate the agreement into its Judgment of Divorce. In the event that a negotiated settlement cannot be reached, the case will be marked for trial. In that event, the Court will listen to the evidence presented by both parties and, at the conclusion of the evidence, the Court will make its own judgment concerning child custody, support, visitation, alimony, equitable division of assets and all other matters on which the parties could not agree.
