How Do You Reaffirm A Debt In Bankruptcy Court?
Bankruptcy is a method of avoiding payment of one’s debts. However, there are several instances in which you would want to reaffirm a debt in order to retain your home (financed with a mortgage), cars or other debts that are owed or which are being financed. Appropriate forms must be filed in accordance with court rules. In most cases, creditors can’t contact you to get you to pay a debt owed to them if the debts are included in your bankruptcy petition. However, after a reaffirmation agreement is approved by the bankruptcy court, the creditor is free to take any action that could have been taken had you not filed bankruptcy. Hire and pay an attorney, if you can afford one. If not, it will be up to you to make sure that you are complying with applicable laws and court rules. Your attorney will need to complete and file a certification that will be filed with the bankruptcy court attesting that you have a valid purpose for reaffirming your debt. Approval is not automatically given. Loca
