An interspousal deed is similar to a quit claim deed. An interspousal deed is a way to transfer property from one spouse to the other. It is often used during or pursuant to a divorce as a way to transfer property that has been jointly titled in the name of both spouses. Additionally, an interspousal deed often allows the parties to avoid tax consequences that frequently accompany the transfer of property. Title the document “Interspousal Transfer Deed.” Include a statement that there is no consideration being given for the transfer of the property. Name the grantor (spouse giving away her rights to the property) and the grantee (the person receiving the other spouse’s rights to the property).
