How Do You File A Responsive Declaration For Child Custody?
The responsive declaration for child custody is a legal pleading used in California divorce proceedings. It is a document prepared and filed by the respondent in a divorce, the spouse on whom the original petition and order to show cause was served. The declaration is a response to the terms set forth in the original divorce petition, terms that include child custody. On the form, the respondent can indicate whether they consent or contest those terms. Complete Form FL-320. The Responsive Declaration form used to respond to a divorce petition is Form-320. It is available online (see Resources). Note that if the respondent does not consent to the child custody terms set forth in the petition, they have space on the form to describe the order (sole or joint custody) to which they would consent. Copy and serve. The completed Form FL-320 should be copied in triplicate and served back upon the petitioning spouse. Either a professional process server, the county sheriff or a personal represe
