You need a R4 device or similiar (M3, Supercard etc.) to take the DS games. Downloading DS ROM images is illegal as they are copyrighted and the owners are probably not happy about people copying them (aka piracy). However, if you download a ‘homebrew’ game or software that someone has written as freeware or shareware then that is completely legal.
