Patent approvals and protection are overseen by the United States Patent and Trademark Office. Issued by the United States government, patents are designed to protect inventors from having their inventions copied by other people and marketed for profit. Patents have utility, design and plant classifications. Utility and plant patents generally provide 20 years of patent protection, with design patents providing 14 years. Consult the United States Patent and Trademark Office patent databases to make sure the invention has not already been patented. Depending on patent type, complete the Declaration for Utility or Design Patent or the Plant Patent Application Declaration. Create an invention description that satisfies the guidelines of United States Code Title 35, Section 112. If drawings will aid the understanding of the invention’s functionality, create these in compliance with United States Code Title 35, Section 113.
