How Do You Collect Interest On Back Child Support In Missouri?
Finding yourself on the losing end of an unpaid child-support order can be frustrating, doubly so when you live in a state that doesn’t provide for interest on arrearages. The state of Missouri, however, provides for interest on unpaid child support arrearages, sometimes referred to as “back child support.” The rate is significant; for back support based upon court orders entered on or after September 1, 1982, interest accrues at the rate of one percent each month. The Revised Statutes of Missouri (RSMo) specify how a parent can go about collecting interest on this debt of the other parent. Show the circuit court clerk a sworn affidavit setting forth the arrears amount and a statement showing how you calculated the interest. To calculate the interest, multiply the first unpaid month by 1.1, add the second upaid month and multiply the new total by 1.1 and repeat the process until you reach the current unpaid month. Remember to credit any partial payments made. Execute on your judgment b
