How Do You Abate A Public Nuisance?
A public nuisance is something that materially alters the use and enjoyment of your private property. A good example would be a nearby nightclub with noisy music every night, or a plant that emits a foul odor or noxious air pollution. It is possible, through a series of legal steps, to abate or stop the public nuisance under certain circumstances. Defenses to abatement do exist. In the end, a compromise or a negotiated settlement might be the best solution. For example, the nightclub can tone down the noise to some extent so that nearby neighbors can sleep. Or the nightclub could continue business as usual but pay monetary damages to the neighbors to make up for the inconvenience they cause. Get a group together of those affected by the public nuisance, or collect a number of signatures on a petition and approach the city attorney or appropriate public official concerning. If the city attorney will not act, an individual or group can still sue for monetary damages in the hopes of putti
