How do Wills and Trusts compare regarding privacy?
A Living Trust is more private. While a Will is generally a very private document during your lifetime, when it is admitted to probate at your death it becomes a public document. In most states, this means than anyone can inspect your Will as well as all other documents that are filed in the probate proceedings. This lack of privacy is very disconcerting to some people, although the general public usually lacks the “how to” knowledge and the inclination to go snooping through probate proceedings.
