How do the Settlements affect the lawsuit against the other Defendants?
The other Defendants (which are all owned by or affiliated with Defendant Masco Corporation) have not settled. The Court has not decided yet whether the lawsuit can proceed as a class action with respect to Masco or who would be included in the class if the Court did allow it to proceed as a class action against Masco. Nor has it decided who is right or wrong in the lawsuit. The Notice is only about the Settlements with CertainTeed, Guardian, Johns Manville and Knauf and the Settlement Class discussed below in Question 6. If the Court decides to certify a litigation class in the lawsuit proceeding against the Masco Defendants, separate notice will be provided.
