The RIAA subpeonas records from your ISP. Your ISP already knows by your usage if it’s likely. From there, it doesn’t take much digging to see whether that usage is high because you’re streaming or you’re downloading. Cyber-evidence tells all. Downloading copyrighted content without paying is illegal no matter where it came from, unless the artist/publisher/author gives permission in the form of a special promotion be it from their web site or that of a legit online seller such as iTunes or Amazon. All these people who are going to say to use torrents instead of shareware sites are able to spin things in such a way as to ease their own guilt and to believe that they won’t get sued, they won’t download a nasty virus.
