How do the federal government and New York State define brownfields?
Public Law 107-118 (H.R. 2869) – the “Small Business Liability Relief and Brownfields Revitalization Act” was signed into law on 11 January 2002. It defines a brownfield site as “real property, the expansion, redevelopment, or reuse of which may be complicated by the presence or potential presence of a hazardous substance, pollutant, or contaminant.” The NYS Brownfields Law (ยง27-1405 of the ECL) defines a brownfield site as “any real property, the redevelopment or reuse of which may be complicated by the presence or potential presence of a contaminant.
