If such students are not attending school, you cannot claim them on your Active Membership. They must be withdrawn and taken off your active roll in accordance with the 10-day rule. Providing the student with homework assignments is not enough to claim membership on the ADM report. Seriously ill students may be counted if they are receiving tutorial instruction from a certified teacher. The student would be reported as ADM Program Type Code 10 – tutorial for up to 5 hours per week. The tutorial instruction must be provided by a certified teacher, not an instructional assistant, and be a comprehensive instructional program consistent with OAR 581-022-1210.
