Before a juvenile record can be expunged in Ohio, it must be sealed. According to the Ohio Revised Code section 2151.358, a juvenile record is expunged five years after the court issues a sealing order or upon the 23rd birthday of the person who is the subject of the order, whichever date is earlier. Prior to this date, a sealed juvenile record can be expunged upon application to the juvenile court. You cannot file for expungement if the victim in the criminal case that is the subject of the sealed records has filed a civil case against you for monetary damages. Additionally, records of the following crimes cannot be sealed: aggravated murder, murder, rape, sexual battery and gross sexual imposition.
