The process is very similar to how the determination of need for an Individualized Education Plan (IEP) is made, as discussed directly above. However, a Formal Evaluation may not be required. The issue under 504 is whether the student has a disability; e.g. a physical or mental impairment that substantially limits a major life function. Major life functions include learning, walking, breathing, performing manual tasks, seeing, hearing, speaking, working, and/or caring for oneself. It also requires that accommodations are needed for the child to access the regular education program. Again, any evaluation completed privately will be considered as part of the Student Support Team process. The need for accommodations depends on the Team’s ability to document that the accommodations are necessary for the student to perform adequately in the regular education program.
