An application to transfer a matter from the Local Court to the District Court, pursuant to section 140 of the Civil Procedure Act 2005, is made by summons and by paying the prescribed filing fee at the registry. The summons is listed in the general motion list (For Sydney matters – for allocation to the Judicial Registrar) On the return day for the summons, the Judge / registrar may make the order by consent providing the grounds contained in the affidavit support the transfer being made.
