Most states prohibit the payment of money to birth parents. All birth parent expenses should be paid out of an escrow account established for the purpose of the adoption. Many courts require that all birth parent expenses paid by the adopting parents be documented. Using an escrow account to make payments helps to insure that all payments are legal and easy to account to the court.
