How can the name of a cocktail recipe be protected?
My client would be promoting the recipe in promotional material to bars and consumers as a vehicle to promote the brand of whiskey. I am concerned that, since the mixture (as described in the recipe for the cocktail) won’t be sold as a product by us, or licensed to bars, we wouldn’t be able to register the name as a trademark or stop other brands of whiskey from using the same recipe same in their promotional materials.
