That rule is only for toilets manufactured after the Act went into effect in 1994. If you build a new home, the toilets you install must use no more than 1.6 gpf. But the Controllable Flush is not a toilet its a retrofit device, so its not affected by the Water Conservation Act. It does, however, give you the same water-conserving benefits of a low-flow toilet without having to replace your existing toilet.
