A plan sponsor will receive an Early Retiree Response File, from HHS’ ERRP Center, following a submission of an Early Retiree List. To the extent a retiree (as opposed to a spouse, surviving spouse, or dependent) on the Early Retiree List is eligible for Medicare coverage during a period of time for which the plan sponsor is seeking reimbursement for that individual, the Early Retiree Response File will indicate that the individual cannot be claimed for ERRP reimbursement during a period of time when the individual is eligible for coverage under Medicare. Given the complexities of data exchanges between HHS’ ERRP Center and the agency that administers Medicare, it is possible that the ERRP-eligible time periods may be adjusted over time to reflect the best available data regarding the retiree’s eligibility for coverage under Medicare. For more information regarding Early Retiree Response Files, please review related materials on the Reference Materials page on this website.
