How can a hookah bar be exempted from an anti-smoking policy?

The hookah bar is exempt if is classified as a: -“retail tobacco establishment” where the main purpose of the business is to sell tobacco products. -“tobacco bar/cigar lounge” where the main purpose of the business is to sell tobacco products and allow customers to consume the products in the bar or lounge.
