Ohio Revised Code Sections 3109.65-3109.80 establish a procedure for grandparents to obtain temporary custody of a grandchild. There are two possible ways to do it. The first way is to have the parent of the grandchild execute a special grandparent power of attorney form. This is a good option when the parent is available. If the parent is unavailable, the grandparent can execute a caretaker authorization affidavit. Both procedures allow the grandparent to enroll the child in school and to obtain medical care for the child. They do not, however, take away the parent?s permanent custody rights.
