How are the UK Biocidal Products Regulations enforced?
In the UK, the Biocidal Products Regulations, made under the Health and Safety at Work etc. Act 1974 (HSWA) and the European Communities Act 1972 are enforced by both HSE and local authority inspectors/trading standards officers. Enforcement for the supply of biocidal products and active substances is carried out by the local weights and measures authorities (usually Trading Standards Officers), who also have the responsibility for enforcing the regulation on advertisements The proper use of products in commercial and industrial undertakings is enforced by HSE and local authority inspectors as determined by the Health and Safety (Enforcing Authority) Regulations 1998.
