How are property and assets divided during a divorce?
In New York, property and assets are divided between the parties according to equitable distribution, as prescribed in New York’s Domestic Relations Law. Equitable does not mean equal; rather, property and assets are divided between the parties based on such factors as their contribution and the circumstances surrounding the case and both parties. Separate property (acquired before the marriage) usually remains separate and marital property (acquired during the marriage) is usually equitably distributed.
