How are Air Reserve Technicians who are on leave without pay to perform duty with the uniformed services treated during a RIF?
Once an employee is placed on leave without pay to perform duty with the uniformed services, he or she is protected from RIF procedures according to the Uniformed Services Employment and Reemployment Rights Act. The employee on leave without pay to perform duty with the uniformed services is not a “competing employee” in RIFs that affect his or her position or competitive area while gone. If the employee’s position is abolished during such absence, he or she is not included in RIF. The organization must restore the employee to another position of like status and pay upon his or her restoration to civilian status.
