Hi, Im having H1B visa and Im going to get married in Jan 5. Can I get my wife to US in tourist or visitor visa and change the ststus to H4 later?.
Srinivasan Technically you can do it. But to get her h4 stamped in her passport, she has to go to India. Please also talk to an attorney in this matter. My H1B got expired and my current employer have already filed for etension(Both my H1 and my wife’s H4). I am changing my job and my new employer will file for a H1 Transfer. My question is my wife who is on H4, need to visit India and return once my H1 extension is approved. Obviously her H4 is expired as of now. Can she get her H4 stamped from US consulate in India without my H1 being stamped . Also another question is when my new employer transfer my H1 , should they transfer H4 also?
