if you don’t have valid leave to remain at the time of your application for a certificate of approval for marriage (you need that) then your application will be declined and you won’t be able to marry. Being marriedwon’t help you if you are already illegal here- the UK authorites won’t be more lenient with you if you happen to be married to EEA citizen. My advice to you would be to return home and do everything the legal way. If this girl is willing to support you then it can be a big help if she chooses to sponsor you to the UK as her spouse. It doesn’t mean it will be granted considering your past immigration track record but the fact that you return off your own back and have someone willing to sponsor you may go in your favour. Seek immigration advise from an immigration solicitor or advisor beforeyou do anything else.
