Has the statute of limitations run on the excise tax payments that date back to March 2003?
No Notice 2006-50 tolled the statute of limitations for the excise tax periods. Instead, the statute of limitations applicable to the income tax returns will apply to the refund claim for the excise taxes. Accordingly, the normal 3 year statute of limitations related to the 2006 income tax return applies to the excise tax claim.
