FORMULA PACKAGES AND FOOD PACKAGES REQUIRING A PRESCRIPTION Question 1: Do we need a prescription for issuance of ready-to-use (RTU) formula if there is a need?
Response: If the request is for a contract formula and the reason is due to inability to mix or for a contaminated or unsanitary water supply, then no (no different that before). All other formulas will require a prescription. For nonexempt noncontract formula, RTU can be issued for the same two reasons they are issued today. Exempt formula for infants now includes two additional reasons for issuance. The CA will need to determine if the request meets these new reasons for issuance.
