For the individual and small group filings, do we have to submit the rate and form filingsconcurrently for the benefit changes effective October 1, 2010?
No. Until further notice we are temporarily suspending the requirement to submit the rate and form filings concurrently, related to the benefit and rate modification due to Patient Protection and Affordable Care Act (PPACA). All other non HCR filings must continue to be filed concurrently. If you decide not to submit the rate and form filing concurrently, you must mention in the SERFF filing description under the General Information Tab that this requirement has been temporarily suspended, pursuant to Health Care Reform. If a corresponding rate or form will be filed at a later date, please provide us with that date. Please also include HCR in the Product Name. We anticipate updating our Washington SERFF filing rule requirements to guide you through this process.
