Factually, what are the “CITY OF KEENE” and the “STATE OF NEW HAMPSHIRE”?
I’m just going to give you the answer that I would give to a person. I want to make sure you understand that I don’t represent the Attorney General for the State of New Hampshire, nor is it my intent to do that. As I understand it, and I’ve been working in local government for a number of years, we derive our authority from the charter as given to us from the State of New Hampshire, which in essence, controls anything a municipality can say or do. We don’t have any authority unless it’s expressly granted to us. If the New Hampshire legislature says we may do this or we shall do this or we must do this, then that is we might do if it is discretionary. But unless it is specifically stated in that fashion, we can’t take any action that is not granted to us by the State of New Hampshire. New Hampshire, I’m not a Constitutionalist to that extent, but as I understand it, derives its powers from the Federal Government. Certainly to the extent that the Federal Government has control over certa
