Doesnt the Second Amendment refer to the militia?
The Second Amendment to The Constitution of The United States of America reads: A well-regulated militia, being necessary to the security of a Free State, the Right of the People to Keep and Bear Arms shall not be infringed. A militia is defined in our Constitution as being every able-bodied man (of a certain age). Additionally, the National Guard is specifically NOT a militia, nor is the US Army (its a standing army). Militias are made up of the citizenry. A different way to say it would be: Since a militia is necessary to keep our Country free, the Right of the People to Keep and Bear Arms shall not be infringed. The framers of the Constitution knew that disarming a people was the first step in enslaving it, and specifically put this safeguard in to prevent that from happening. Recently, a Congressional committee has officially determined that the Second Amendment is an individual Right, not a collective one. The Supreme Court may have finally begun to follow suit.
