Does the Supreme Court have judicial review over state constitutional amendments? ?
One of the beauties of the Federalist society that we have created is that if it is not an enumerated right in the Constitution, state matters cannot be reviewed by the Supreme Court. Even if they could get by on an equal protections claim, the makeup of the court would have to change dramatically before they would step out to rule on a state-voted constitutional amendment. 26 states have similar amendments and nothing has happened so I doubt anything will until the next election where they will try to revoke it.
