A25: Yes. The determination regarding what level of incidental take would result in a negligible impact to manatees is solely biologically based. However, we always consider the impact on local economies and public quality of life when making decisions which will result in additional regulations, per the requirements of applicable Federal laws, policies and Executive Orders, including but not limited to the National Environmental Policy Act, Regulatory Flexibility Act, and Small business Regulatory Enforcement Flexibility Act.
