Does the selling broker represent the buyer or the seller?
Under Wisconsin Agency law, the selling broker or agent is the sub-agent of the seller and owes loyalty to the seller. The selling broker can represent the buyer if the selling broker has a Buyer Agency agreement with the buyer. In that case, the selling broker owes loyalty to the buyer. It is important for you as a seller to know whose interest the selling broker represents. A Buyer’s Agent, by law, is required to make a disclosure of their representation of the buyer to you, as seller. If a sale through a Buyer’s Agent is consummated, the seller will be responsible for payment of the agreed upon commission as offered in MLS.
