Does the order have to be amended if the placement stipulated in the Residence Requirement breaks down?

Not necessarily. The legislation allows for the young person’s placement to be changed with approval from the responsible officer (that is the YOT) but only if the power to do this is specified in the order. Where this has not been specified, then YOTs will need to have the order amended. Where the young person is placed with a specified person and that person no longer wishes to comply, the order would need to be amended. The YOTs do not have the power to change the ‘specified person’.
